TERMS OF USE OF THE WEBSITE

1 - Foreword

1.1 These terms of use (hereinafter referred to as the Terms) govern access to and consultation of the website hereinafter referred to as the Website) and apply to its contents.

1.2 Relations with users are governed not only by these Terms, but also by the general terms and conditions of sale (available at the LINK), the privacy policy (available at the LINK) and the cookie policy (available at the LINK).

1.3 By using the Website, the User confirms that he/she has read, understood and accepted these Terms and any changes to them.

2 - General Information regarding the Supplier

2.1 The Website is managed by Irsap spa (Supplier), present in Arquà Polesine (RO), Via delle industrie 211, P.IVA 00040070294.

3 - Website navigation and possible registration

3.1 Users may navigate and access the Website services by following the rules specified in the individual sections of the Website itself (ecommerce section, commercial partners section, ...).

3.2 If the User is required to register, he/she shall do so by filling in the relevant form and entering the required data (name and company name, registered office, telephone number and e-mail address, first and last name of physical contact person, customer number).

3.3 The access credentials that may be generated at the time of the registration as referred to in the previous paragraph shall be kept by the user under his sole responsibility.

4 - Newsletter Service

4.1 The User may make use of the newsletter service by requesting subscription to it, after entering his or her e-mail address in the form provided.

4.2 The newsletter service is optional and free of charge, and the data are collected and processed in full compliance with privacy legislation, as set out in the privacy policy available at the following LINK.

4.3 The User may unsubscribe from the service at any time by clicking on the "Unsubscribe" option in each e-mail.

5 - Access to the Website

5.1 The User accesses the Website under his or her sole responsibility and the Provider shall not be liable for any damage caused by access problems.

5.2 The Supplier also reserves the right to suspend access at any time and for any cause whatsoever, including malfunctioning, either temporarily or permanently, giving notice thereof by means of an appropriate notice published on the Website home page.

6 - Protection of Copyright and Intellectual Property Rights

6.1 The Website, all data, textual content and multimedia elements - such as images, photographs, video and audio files - are intellectual works and as such protected by the Industrial and Intellectual Property Code (Legislative Decree no. 30/2005), the Italian Law on the Protection of Copyright and Other Rights Related to its Use (Law 633/1941 as amended), the provisions of the Criminal Code, the rules contained in international treaties, and the laws in force in the country where it is used.

6.2 The textual information and multimedia elements - and in general all Website content - as well as the design, graphics, technological and operational layout, are the property of the Supplier or of third parties from which the Supplier has obtained the right to use them.

6.3 The User is therefore obliged to respect the intellectual property rights of the Provider and/or third parties.

6.4 The use, reproduction, copying and distribution of the textual information and multimedia elements on the Site, as well as the hyperlink to www.irsap.com is prohibited.

6.5 Such activities are subject to prior authorisation by the Supplier, or by the third party holder of the intellectual property rights. It is the User's responsibility to obtain information regarding the ownership of these rights.

6.6 Irsap is a registered trademark of the Supplier and, therefore, any use thereof without prior written consent from the Supplier is prohibited.

6.7 www.irsap.it and www.irsap.com are domains registered by the Supplier and any use of them by non-authorised third parties is therefore prohibited.

6.8 The registered trademark Termoarredatori, all trademarks and other distinctive signs on the websites www.irsap.it and www.irsap.com are the exclusive property of Irsap spa and any use by third parties is prohibited.

7 - Exclusion of Liability

7.1 The Supplier disclaims all liability for damage caused by viruses and malware, errors, omissions, deletions, network problems, theft, unauthorised access to and alteration of data, independent of its actions and/or omissions.

7.2 The Provider also declines all liability for any claims by the User relating to the User's inability to access and use the Website for any reason whatsoever.

7.3 Furthermore, the Supplier shall not assume any liability for damage, claims or losses caused to the User due to the failure and/or defective functioning of the User's own computer systems or those of third parties, including Internet Service Providers, telephone and/or telematic connections not operated directly by the Supplier or by persons for whom the Supplier is responsible.

7.4 The Supplier does not assume liability for infringement of intellectual property rights by third parties through the Website.

8. Protection of personal data

• The Supplier undertakes to process the personal data collected for customer registration in compliance with the legislation for the protection of personal data (GDPR and TU 196/03 as amended by legislative decree 101/18) and for the purposes and in the manner better specified in the information provided pursuant to Art. 13 Reg. 679/16 EU available at the following link www.irsap.com/privacy

9. Applicable Law and Jurisdiction

• The relationship established following registration on the Website is governed by Italian law.
• For any dispute between the parties concerning the relationship, the competent jurisdiction shall be the court in whose district the consumer has his/her domicile, in accordance with the laws in force; for all other customers (foreigners or non-consumers) it is agreed that any dispute, even in derogation of the rules on territorial competence, shall be the exclusive competence of the Court of Rovigo.
